Textbooks.com Terms and Conditions Update

Textbooks.com has updated the terms and conditions relating to its affiliate program. Please be sure to review the terms and conditions below:

"Net Monthly Sales" means the net dollar amount of Products sold to Qualified Customers during a calendar month. Net Monthly Sales are calculated exclusive of fraudulently placed orders, returned orders, transportation and packaging costs, insurance, duties, taxes and other governmental charges, and discounts or rebates actually granted by Marketer. "Qualified Customer" means any individual or entity that is tracked by GAN's proprietary technology, ConnectCommerce™, and who, within the period of time as set forth in ConnectCommerce™ and/or any applicable Textbooks.com Specific Terms, clicks through to the Textbooks.com Site via hyperlinks contained within any Offer displayed in accordance with this Agreement and purchases Products from the Textbooks.com Site.

Publishers will initially earn 6% for all Net Monthly Sales. Publishers can earn higher commissions upon generating more than $500,000 in annual sales. Publisher's tier will be determined by total annual sales generated between September 1 and August 31 of the given fiscal year as outlined below:

Publishers who are residents of New York, North Carolina or Rhode Island will not be eligible to participate in the Textbooks.com Affiliate Program or otherwise earn referral fees. If, at any time following enrollment in the Textbooks.com Affiliate Program you become a resident of New York, North Carolina or Rhode Island, you will become ineligible to participate in the Program and forfeit unpaid commissions.

Publisher may not purchase, register, or bid on keywords, search terms or other identifiers for the brand "Textbooks.com" or variations thereof (for example "textbooks com", "text books com", "text books.com", "textbook.com", "textbook com", etc.) for use in any search engine, portal, sponsored advertising service or other search or referral service. In addition Publisher agrees to add "textbooks.com", "textbook.com", "textbooks com", "textbook com" as negative terms to your campaigns to avoid broad/phrase matching and to prevent violation of this guideline. Publisher may not use the Textbooks.com or Textbook.com brand name in the display URL on any search engine, portal, sponsored advertising service or other search or referral service and may not mask the URL with the Textbooks.com or Textbook.com brand. Publishers are prohibited from using the language "official site" or variations thereof in ad copy and from adding trademark symbols to ad copy. The use of any form of advertising that creates the impression that the Publisher's site, pop-up, pop-under or any other form of advertising is Textbooks.com, is prohibited.

Publisher shall not reproduce, distribute, republish, sub-license or otherwise make offers, content or datafeeds available to any third party or domain not owned or exclusively operated by Publisher, including but not limited to third party shopping sites (e.g., Shopping.com, MSN Shopping, eBay, Google Products, AOL, etc). Any exceptions to this must be granted in writing to Publisher by Textbooks.com.

Publisher may not "spider" or "crawl" the Textbooks.com Site - i.e., use a program to recursively or automatically explore the Textbooks.com Site to harvest or retrieve information. Textbooks.com reserves the right to block any IP address that "spiders" or "crawls" the Textbooks.com Site. Publishers may only use content, logos, ads, coupons and promotional codes that are provided through the Textbooks.com Affiliate Program.

Publisher is prohibited from issuing a press release describing the relationship or the terms of this agreement without prior written approval. Publisher is prohibited from including Textbooks.com in any email or print format without prior written approval.

Violations of these terms may result in forfeit of unpaid commissions from the point of violation and/or immediate termination from the Textbooks.com Affiliate program.

Textbooks.com may at its sole discretion modify these terms.
